Os direitos serão pagos pelo peso de cada mercadoria, depois de deduzida a tara. Se extre o negociante purtagarn o o empregado da sifandege houver duvidas no fixar da tara, cada uma das partes escollerá um certo numero de caixas ou de fardus d'en- tre cada con da ercatoria em questão, tamar-se-ha o peso brute d'esse volume, tisen- do depois a tara de cada um d'elles, e a tara media que rusnitar será a adoptada para todos.
No caso de qualquer outra duvida ou contestação, aqui não designada, o negocianto portugnen poderd, appellar para o seu consud, e gial communicará a questão ao supe- rintendente da alfandega, e este fará por conclail-a aunigavelmente. A appellagão, po- rém, só poderá ser atendida quando seja feita dentro do praso de vinte e quatro ho- ma; e, n'este caso, até que a duvida seja resolvido, não se poderá fazer nos livros da alfandega assento algum relativo ás mercadorias em questão.

Artigo XXXVIII

Os navios mercantes portaganzes ad poderão frequentar os portos da China, que estiverem abertos ao commercio estrangeiro. Artigo XLV
Cpon arrival of the ship at the port to which the goods are carried, permission will be granted to land without any now payment of duties whatsoever, if, upon exa- mination, they are found to be the identical goods; but if during the examination, any fraud be detected, the goods may be confiscated by the Chinese Government.
Shoul any Portuguese merchant wish to reexport to a foreign country any goods importe and upon which duties have been already paid, he will have to make his ap- plication in the same form as required for the reexportation of goods to another port in China, in which case a certificate of drawback or of restitution of duties will be gran- ted, which will be accepted by any of the Chinese custom-house in payment for import or export duties.
Foreig cereals imported by Portuguese chips into the parts of China may be re- exported without hindrance, if no portion of it has been discharged.
Article XXXVI
The chinese authorities will adopt at the ports the measures which they may deent the most convenient to avoid fraud or sunggling.
Article XXXVII
The proceeds of fines and confiscations inflicted on Portuguese subjects, in confur- mity to thsi treaty, shall belong exclusively to the Chinese Government.
Article XXXVII
Portuguese subjects carrying goods to a market in the interior of the country on which the lawful import duties have already been paid at any of open ports, or those who buy native produce, in the interior to bring to the ports on the Yangtae-Kiang, or to send to foreing ports, shall follow the regulations adopted towards the other nations.
Custom-house Officers who do not comply with the regulations or who may exact more duties then are due shall be punished according to the Chinese kors.
Article XXXIX
The Consuls and local authorities shall consult together, when necessary, as to the construction of Eight-houses and the placing of buoys and light ships.
Article XL
Duties shall be paid to the bankers authorised by the Clincan Government to re- ceive them in sgence or in foreign coin according to the official assay made at Canton on the 15th July 1845.
Article XLI
In order to secure the regularity of weights and measures and to avoid confusiom the Superintendent of custome will hand over to the Portuguese Cursul at each of the open ports standards similar to those given by the Treasury Department for collection of public dues at the enstows at Canton.
Article XLIT
Portuguese merchant ships may resort only to those ports of China which are de- clored open to eximeren. Portuguese subjects who may have any complaint or claim against any Chinese subject, shall lay the same before the Cupsid, who will take duo cognizance of the ense and will use all his efforts to settle it amicably. Likewise, when a Chinese subjent shall have occasion to complain of a Portuguese subject, the Consal will listen to his cor- plaint and will do what he possibly can to re-establish harmony between the two par-

2 All opium imported into Macau mast fouthwith ou arrival, be reported to the competent department under a public functionary appointed by the Portuguese Go- vornment to superintend the importation and exportation of opium in Macatt
3o No opium imported into Macau shall be tranehipped, landed, stored, removed from one store to another or exported, without a permit issued by the Superintendent.
